PARTICIPATION ACKNOWLEDGMENT I, the undersigned parent/legal guardian and athlete, understand that participation in volleyball activities, including but not limited to practices, training sessions, tournaments, scrimmages, conditioning, travel, lodging, team events, and related activities sponsored by the Club involves inherent risks. These risks include, but are not limited to: Slips, falls, and collisions; Sprains, strains, fractures, and dislocations; Head injuries and concussions; Heat-related illness; Permanent disability; Illness, including exposure to communicable diseases; Emotional stress; Property damage; and Serious injury or death. I acknowledge that volleyball is a physically demanding sport and that injuries may occur despite reasonable safety precautions. I certify that the athlete is physically capable of participating in volleyball activities and has no medical condition that would prevent safe participation except as disclosed in this document. ⸻ ASSUMPTION OF RISK I knowingly and voluntarily assume all risks associated with participation in Club and USA Volleyball activities, whether known or unknown, foreseeable or unforeseeable, including risks arising from ordinary negligence. I understand and acknowledge that participation is entirely voluntary and that I may withdraw the athlete from participation at any time. ⸻ RELEASE OF LIABILITY AND WAIVER OF CLAIMS TO THE FULLEST EXTENT PERMITTED BY NEW MEXICO LAW, I, ON BEHALF OF MYSELF, THE ATHLETE, OUR HEIRS, REPRESENTATIVES, ESTATE, INSURERS, AND ASSIGNS, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE: The Club; USA Volleyball; The Regional Volleyball Association; Tournament hosts and facilities; Coaches, directors, trainers, volunteers, officials, employees, contractors, sponsors, and agents; Facility owners and operators; and Any affiliated organizations or representatives; (collectively referred to as the “Released Parties”) from any and all claims, demands, damages, causes of action, losses, liabilities, costs, attorney fees, or expenses arising out of or related to participation in Club activities, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. This waiver does not apply to conduct constituting gross negligence, reckless conduct, or intentional misconduct to the extent prohibited by New Mexico law. ⸻ MEDICAL AUTHORIZATION In the event of illness or injury, I authorize the Club and its representatives to obtain emergency medical treatment for the athlete when a parent/guardian cannot be reached immediately. I understand that: Emergency treatment may include transportation, hospitalization, diagnostic procedures, and medical care; I am solely responsible for all medical expenses incurred; The Club does not provide medical insurance coverage unless specifically stated otherwise. I authorize licensed healthcare providers to administer treatment deemed medically necessary. CONCUSSION ACKNOWLEDGMENT I acknowledge that: Concussions and head injuries are serious medical conditions; Symptoms may not appear immediately; The athlete must report any head injury symptoms immediately to coaches or staff; The athlete may be removed from participation if a concussion is suspected; Medical clearance from a licensed healthcare provider may be required before returning to participation. I understand that the Club follows applicable USA Volleyball and New Mexico youth sports safety guidelines regarding concussion awareness and return-to-play procedures. COMMUNICABLE DISEASE ACKNOWLEDGMENT I understand that participation in sports may expose the athlete to communicable diseases, viruses, bacteria, or other health conditions, including but not limited to COVID-19, influenza, MRSA, and other contagious illnesses. I voluntarily assume these risks and agree not to hold the Released Parties liable for illness exposure except as prohibited by law. CODE OF CONDUCT The athlete and parent/guardian agree to: Demonstrate good sportsmanship; Respect coaches, officials, teammates, opponents, and spectators; Follow all Club policies and USA Volleyball rules; Refrain from bullying, harassment, discrimination, threats, or abusive conduct; Avoid possession or use of alcohol, tobacco, nicotine products, illegal substances, or weapons during Club activities; Follow facility and travel rules. The Club reserves the right to suspend or remove any athlete or parent from participation for misconduct, safety concerns, or policy violations. No refund is guaranteed in the event of suspension, dismissal, withdrawal, or removal from the program. ⸻ PHOTO, VIDEO, AND MEDIA RELEASE I grant permission to the Club, USA Volleyball, and affiliated organizations to photograph, record, livestream, or otherwise use the athlete’s name, image, likeness, voice, and performance for: Social media; Promotional materials; Websites; Broadcasts; Recruiting materials; Team communications; and Educational or marketing purposes. I understand that no compensation will be provided for such use. I may revoke this consent in writing for future use only. EQUIPMENT AND PROPERTY I understand that the athlete is responsible for properly using Club equipment and facilities. I agree to reimburse the Club for damage caused by intentional misconduct, abuse, theft, or reckless behavior. The Club is not responsible for lost, stolen, or damaged personal property. ⸻ PAYMENT AND REFUND ACKNOWLEDGMENT I understand that Club dues, tournament fees, travel expenses, uniforms, and related costs are non-refundable. Missed practices, injuries, schedule changes, suspensions, or voluntary withdrawal do not guarantee refunds.
